Research On Digital Intellectual Property Rules In International Trade

The development of technology drives the arrival of a new era,and digital technologies have become the dominant theme of this era.The emergence of digital economy triggered the butterfly effect,and international digital trade began to become a new form.The change of trade patterns has spawned new trade objects---digital products.The special properties of digital products have also slightly changed the intellectual property attached to them.The speed of technological updating in the digital age is obviously accelerated,and the digital intellectual property also shows some differences with the traditional intellectual property.As one of the adjustments of international trade rules,intellectual property rights have changed.But it remains to be seen whether the existing rule system can operate as usual to keep international digital trade in order.At present,countries and regions have taken note of digital intellectual property and tried to develop new rules in self-dominated international trade agreements.The old order system has not yet retreated,but the new rules are not yet mature.At this crossing,it is necessary to discuss and analyses the current rule system.Nowadays,the rules system is made up of several parts,including the WTO structures and different rule modes made by the USA,EU,CHINA and ASEAN.Through the examples and evaluation of the rules,it is easy to find that the current rules on digital intellectual property in international trade stay in a state of fragmentation.Such a state is so easy to breed digital intellectual property barriers that the technology gap between developing countries and developed countries has been widened,which will inevitably have a negative impact on the development of international digital trade.In this regard,all countries take actions---actively consulting,holding discussions,seeking common ground while shelving differences,and working together to build a whole-round system of trade rules.While consolidating the construction of the domestic digital intellectual property legal system,China,as a representative of a developing country,demonstrates the style of a major country on the international stage,presents China’s plan to the world,and promotes the improvement and coordinated development of the digital intellectual property rule system.
