Research On The Constitutional Expression Of "People"

“People” has rich historical,humanistic,political and legal connotations,but it is also easy to cause controversy.When a concept is difficult to define from the inside,examining it from the outside makes the concept even clearer,as does the concept of “the people” in our constitution.Through the investigation of the discourse connotation of “people” in different subject areas,we can better clarify the discourse connotation of “people” in the field of constitutional law.By combing and analyzing the expression of “people” in the constitutional texts promulgated after the founding of the People’s Republic of China,investigating the evolution course of “people”discourse in the history of Chinese constitutional system,and comparing the expression of“people” in the constitutional texts of other countries in the world,we can find out the common and special features of “people” discourse expression in Chinese constitution.And it can help establish a clear understanding of the issue of “the people” discourse in our constitution.While comprehensively understanding the pluralistic connotation of “people”,we should also pay attention to a series of problems caused by the expression of “people” in the constitution.Specifically,it includes: the attribute of “people” discourse,that is,whether “people” is political discourse or legal discourse;The problem of the meaning of “people” discourse,that is,whether the meaning of “people” in the constitution is equal to “citizen” or “national”;The question of the discourse design of “people” in the constitution refers to what kind of discourse design and what specific path should be adopted to ensure the realization of the subject status of “people”under the background of “people-centered”.Through the study of these problems,it is helpful to understand the unique position of “people” in the contemporary discourse of rule of law,and better implement the thought of “people-centered” rule of law.
