Research On The Legal Guarantee Of Digital Government Construction From The Perspective Of Network Security

The construction of a digital government is not only a new solution for deepening administrative system reform,streamlining administration and delegating power,and building a smart government in the era of big data,but also an external manifestation of the construction of a rule of law government under the comprehensive rule of law strategy.In August 2021,the "Implementation Outline for the Construction of a Rule of Law Government(2021-2025)" was released,proposing the new concept of "digital rule of law government",which was also the first official confirmation of the authority of this statement in China;This outline specifies the construction framework,goals,and specific implementation plans for a digital rule of law government.In June of the following year,the State Council issued the "Guiding Opinions on Strengthening the Construction of Digital Government",clearly proposing to accelerate the establishment and improvement of a legal and regulatory system that is compatible with the construction of digital government.It is evident that in the process of comprehensively promoting the construction of a digital rule of law government,attention should be paid to ensuring the rule of law in the selection and security of digital technology embedding.However,as a core force in promoting and ensuring the high-quality development of digital rule of law government,cybersecurity has become increasingly severe and complex with the continuous deepening of digital government construction.In order to address the increasingly complex network security issues of digital government,it is necessary to use legal means to ensure the smooth,safe,and efficient operation of the digital government,comprehensively build a network security legal protection network,effectively hold the bottom line of security protection for digital construction,and achieve the goal of becoming a strong cyber country and a digital China as soon as possible.Improving the legal guarantee for the construction of digital government under network security aims to construct a solid defense line for the end of digital government network security from the legal perspective,relying on legal means.At present,there are several problems in the construction of digital government under network security at the level of legal protection,including incomplete relevant laws and regulations,incomplete network security management system,shortage of digital legal compound talents,need to strengthen data security protection,need to transform the mindset of some leaders and cadres,and need to improve the public’s awareness of network security and the rule of law.Based on the above practical issues and drawing on the excellent experience of rule of law protection in Singapore,the United States,Guangdong,Zhejiang,and other regions in China,the following targeted improvement suggestions are proposed: firstly,to form a complete system of relevant legal norms and increase institutional supply;Secondly,the smooth operation mechanism of digital government network security and the implementation of network security responsibilities;The third is to consolidate the foundation of a high-quality composite talent team and build a solid protective force;Fourth,strengthen data security protection and strictly adhere to the defense line in key areas;Fifth,improve the network security guarantee ability of leading cadres and play their "leading role";Sixth,innovate publicity and education methods to enhance the public’s awareness of the rule of law in cybersecurity.Through these measures,we aim to create a favorable cybersecurity environment for the construction of a digital government and provide practical and strong legal support.
