"The rule of law is an important achievement of human political civilization and a basic means of modern social governance." Achieving the rule of law in social governance is a requirement for implementing the strategy of governing the country by law.As an important component of social governance,university governance must also achieve the rule of law.Disciplinary action in colleges and universities directly refers to the field of university governance.Only by realizing the legalization of disciplinary action in colleges and universities can we effectively protect the rights and interests of students,promote the process of managing schools according to law,and achieve the legalization and modernization of university governance.The first part is about the basic theory of the legalization of university discipline,which summarizes the two attributes of autonomy and administration of university discipline,divides the types of university discipline,and defines the connotation of the legalization of university discipline.The purpose is to derive the basic requirements for the legalization of university discipline.The second part summarizes the specific manifestations of disciplinary deviation from the rule of law in universities,including deviation from the rule of law in disciplinary rules,improper implementation of disciplinary measures,and obstruction of relief channels.The third part is about the ways to realize the legalization of punishment in colleges and universities,including that the formulation of punishment rules in colleges and universities must meet the requirements of legalization,such as adhering to the rule of law thinking such as legal priority,legal reservation,and the principle of proportionality;It also includes that the implementation of disciplinary measures in universities must meet the requirements of legality,such as the need to accurately invoke disciplinary rules when implementing disciplinary measures in universities,the need for universities to discipline students to listen to their statements and defenses in order to comply with the principles of due process,and the need to improve the hearing system and avoidance system;It also includes improving the school appeal system and administrative relief system to smooth the relief channels for students.The research idea of this article is to first analyze the background of the legalization of disciplinary action in colleges and universities,use the literature analysis method to deeply analyze the current research situation of the legalization of disciplinary action in domestic academic circles,and use the normative analysis method to sort out the basis of disciplinary action in colleges and universities,including national legislative norms and campus norms;Based on this,combined with the current situation of university discipline,this paper analyzes the basic theory of legalization of university discipline,including the concept of university discipline,the scope of university discipline studied in this article,the characteristics of university discipline,and the types of university discipline.Secondly,combined with the requirements of the rule of law in social governance,we further derive the connotation of the rule of law in university discipline.Using empirical analysis and case analysis methods,this paper summarizes the specific manifestations of disciplinary deviation from the requirements of the rule of law in universities and analyzes the causes.Finally,based on the rule of law thinking and methods,this paper proposes a path to the realization of the rule of law in university discipline.The main innovation of this article lies in taking the thought of rule of law as the guide,using Xi Jinping’s thought of rule of law and the method of rule of law to implement university discipline.
