A Study On University Management Through The University Statutes

As a carrier of the modern university system,the university statutes is the principle and the general rule of university administration according to law.It is universally binding within the university.The Education Law of the People’s Republic of China promulgated in 1995 and the Higher Education Law of the People’s Republic of China issued in 1998 respectively made corresponding regulations on the university statutes.China’s Higher Education Law requires that each university should have their own statutes,but now a considerable number of schools have not developed a statutes,or the statutes has not been implemented under supervision.After releasing the National Long-term Education Reform and Development Plan(2010-2020),the State Council,on October 24,2010 issued a notice about the implementation of national education system reform pilot,pointing 26 colleges and universities as pilot colleges and universities including Peking University and Beijing Normal University,to promote the establishment of a sound university statutes.However,there are still a lot of problems in the present university statutes,such as the university statutes,as the highest authority in the system of rules and regulations,is the basis of other rules and regulations,how the statutes clarify the legal statutes of relevant subjects in higher education and the rights and obligations between the university and government,and how to rationalize the the legal relationship between universities and teachers,universities and students,as well as teachers and students?The thesis,through the theoretical analysis of the university statutes and the statutes quo,analyzes problems in the process of the formulation and application of the university statutes and discuss how to improve the university statutes.The thesis is divided into four parts:First,the theoretical discussion.Analyzing the feasibility and theoretic foundation of the university statutes,and provides the theoretical support and the practical basis for the university management through the university statutes by analyzing of the main function of the university statutes.Second,the analysis of the problems and causes of university management.Under the modern university system,highlight some problems in university management,and then analyze the causes of the problems,concluding in that the scientific management of the university needs to be regulated by the university statutes.Third,solve the problems in university management through the university statutes.In the process of the operation of the university statutes,it can not avoid a variety of complex with social subjects.As the statutes in the intricate relationships among the network,it is more necessary to regulate the university statutes to sort out the rights and interests of various subjects,which to solve the problems in the operation of the university system from two levels.First,coordinate the university’s external management relations through the university statutes;second,build the university internal management structure through the university statutes.Fourth,explain how to give full play to the functions of the university statutes in the future and improve the system of university statutes.This part,based on the theoretical analysis and the causes of the problems in the above parts of the thesis,puts forward some suggestions on perfecting the system of the university statutes by finding the deficiency and deficiency of the university statutes in practice.The thesis clarifies how to perfect the system construction of the university statutes from three aspects;clarifying the legal status of the university statutes,clarifying the internal and external legal relations which should be adjusted by the clarifying,and strengthening the formulation of the regulations.
