Research On The Legal Regulations Of The Utilization Of China’s Non-key Protected Wildlife

Wild animals have been closely related to the survival and development of human beings since ancient times,and with the acceleration of human civilization,wild animals have now become an extremely important natural resource of the country.At the same time,with the development of economy and society and the strong demand for diversification,the use of wild animals has become more and more active,whether it is hunting and artificial breeding of wild animals in the upstream of the use of wild animals,or the sale,purchase,transportation and other business utilization activities in the middle and lower streams,the use of wild animals in the society has formed an increasingly mature industrial chain of wild animal utilization.China’s wildlife management is carried out from the classification and grading system,and wild animals are divided into key protected and non-key protected wild animals from the perspective of precious and endangered,which means that key protected wild animals are of course at a higher level of protection in China,so the current national laws on the protection and utilization of key protected wild animals have gradually matured and improved,the public has reached a consensus on the protection concept of key protected wild animals,and the illegal use of key protected wildlife resources has also been severely cracked down.However,in the context of vigorously building ecological civilization and advocating harmonious coexistence between man and nature,whether it is key protected wild animals or non-key protected wild animals,their economic attributes in the entire ecosystem should not be amplified,and their ecological attributes for maintaining the smooth operation of the ecosystem are indelible.Now we must focus on non-key protected wild animals,respect the ecological value of general wild animals,and improve legal regulation on the use of non-key protected wild animals.This paper focuses on the current situation of the use of non-key protected wild animals in China,analyzes and summarizes the shortcomings of the current legal regulation of non-key protected wild animals in society,and sorts out the relevant advanced experience outside the region,and finally puts forward suggestions for improvement.This paper first starts from the concept of wild animals,defines the concept scope of non-key protected wild animals,systematically sorts out the development process of the legal regulation of wild animal utilization in China,clarifies the past and present life of China’s wildlife utilization regulation,and paves the way for the following research content.Then,the current situation and deficiencies of the legal regulation of the use of non-key protected wild animals in China are discussed,and the shortcomings are classified and sorted out on the basis of a clear understanding of the current situation of legal regulation in China.Then,looking at the international community,we will learn from the advanced experience of the legal system for the use of non-key protected wild animals outside the region,so as to provide reference for improving the legal regulation system of non-key protected wild animals in China.Finally,under the summary of the previous research results,suggestions for improvement are put forward,starting from the shortcomings of the previous legal regulations: first,improve the provisions of non-key protected wild animals in the Wildlife Protection Law,expand the scope of the definition of "wild animals" in the law,and clarify the provisions on the identification of use;Secondly,improve the provisions of the permit system for non-key protected wild animals,and improve the hunting system and artificial breeding system;It is again advocated to increase the content of special labels for non-key protected wild animals,so as to better activate the comprehensive wildlife traceability mechanism;Next,the wildlife management system will be optimized to better help regulate the use of non-key protected wildlife;Finally,strengthen the regulation of the use of wild animals under non-key protection in the criminal law.In summary,combined with the actual situation in China,in order to provide feasible solutions for the future legal regulation of the use of non-key protected wild animals in China.
