| As one of the most influential FTAs in the world today,the signing and entry into force of RCEP means a new shift in the global data governance landscape,a shift that is significant for less developed countries-they can now participate in the negotiation and formulation of international rules.As for the cross-border data flow regulation discussed in this paper,since the less developed countries are relatively lagging behind in digital technology development.Compared with the data flow governance schemes of the EU and the US,the cross-border data flow under the RCEP framework not only attaches importance to national data sovereignty and data security,but also does not sacrifice the freedom of data flow across borders.It is worth noting that the provisions of the RCEP on cross-border data flows can help promote regional digital governance and improve global data flow rules,given that the relevant WTO rules are obviously lagging behind technological development.Because the impact of cross-border data flows under the RCEP framework on the existing rules cannot be underestimated,this paper follows the overall collaborative approach of background introduction-theoretical explanation-current situation summary-challenge analysis-proposed strategies to analyze the challenges faced by the regulation of cross-border data flows under the RCEP framework and propose recommendations to improve the regulation of cross-border data flows under the RCEP framework.The study finds that China mainly faces challenges such as insufficient convergence with domestic regulations,inadequate domestic mechanisms,and deficiencies of RCEP data flow rules itself when participating in cross-border data flow regulation under the framework of RCEP.In this regard,China needs to work on enhancing the convergence of cross-border data flow rules with domestic regulations under the RCEP framework,constructing a domestic mechanism for cross-border data flow under the RCEP framework,and building a governance system for cross-border data flow under the RCEP framework. |
