| The Fourth Plenary Session of the 19 th Central Committee of the Party put forward the idea of upholding and perfecting the new pattern of social governance of“co-construction,co-governance,and sharing”.As an important part of participating in social governance,the Fuzhou City Trade Union insists on the job orientation of“what is urgent and what the trade union can do”,always keeps in mind the safety of the workers and the masses,and seizes the most direct and practical interests of the workers.Therefore,it is urgent to put the construction of the rights protection function in the first place,to improve the rights protection function of the trade union in multiple dimensions,and to protect the legitimate rights and interests of employees from being infringed.By doing so,the important duty of the rights protection of the trade union can be effectively brought into play.The thesis is designed to discuss the establishment and improvement of a negotiation and coordination mechanism involving the participation of the government,trade unions,and enterprises,to reduce the cost of rights protection,to build harmonious labor relations,to promote decent work and all-round development of employees,and continuously increase the happiness of employees.In recent years,the Fuzhou City Trade Union has been very effective in safeguarding rights.It has continued to carry out labor law supervision of labor unions,actively prepared for the Seventh Five-Year General Law review and acceptance,carried out various forms of publicity on the rule of law,actively built harmonious labor relations,focused on the development of the "Park Maple Bridge" mechanism pilot projects and promoted the improvement and expansion of the staff warming project.However,the Fuzhou Trade Union also encountered a series of problems in the process of safeguarding the legitimate rights and interests of employees.For example,the democratic management mechanism of employees needs to be improved due to conflicts caused by the dual identity of the union,and the employee appeal expression mechanism has shortcomings caused by the mismatch of the service supply and demand of the union.The lack of legal rigidity of trade unions has caused problems such as the lack of policy and legal protection mechanisms,and the lack of trade union team building,resulting in the imbalance of internal talent mechanisms in the organization.Therefore,this article selects some government agencies,state-owned enterprises,private enterprises,foreign-funded enterprises and other different types of enterprises in Fuzhou as samples.Through the research on the construction of the rights protection function of the trade union,the analysis the main reasons that restrict the effectiveness of the rights protection of the trade union,and the usage of the experience and practices of the trade unions in developed countries to perform the rights protection function,the thesis is aimed at the practical dilemma faced by the construction of the rights protection function of the trade union in Fuzhou,and then put forward four aspects of improvement suggestions : The first is to establish a long-term democratic management mechanism through the weak administrative subsidiary status of the Chemical Industry Association,standardize the construction of democratic management,and strengthen the rights protection service and feedback mechanism;the second is to speed up the promotion of small and medium-sized enterprises and informal employment groups to form labor unions by removing the “official” color,promote the establishment and regulation of the mechanism for expressing employees’ appeals and improve the recognition of workers’ rights protection by trade unions;the third is to strengthen the legislative "source participation",highlight employee legal rights protection services,and work with labor supervision departments to consolidate a new foundation for labor unions to protect their rights according to law;the fourth is to strengthen the construction of the union’s own team by restructuring the dialogue and consultation mechanism between party workers,political workers and enterprise employees,strengthening hierarchical management,improving the overall quality of union employees,and enhancing the means of safeguarding rights.The Fuzhou City Trade Union hopes that through the implementation of the above-mentioned solutions in actual work,some of the problems faced by the construction of rights protection functions can be solved,and the construction of harmonious labor relations can be promoted.It also hopes that it can provide lessons for the development of trade unions in other regions. |
