Research On The System Of Administrative Reconsideration Committee In China

Since the pilot of the Administrative Review Committee,the level of administrative review has gradually improved,the maintenance rate of review has decreased,the error correction rate has increased,and the credibility of the results of administrative review has been enhanced.But the administrative review committee itself still has some shortcomings.In order to deepen the reform of administrative review system and give full play to the role of administrative review system as the main channel for resolving administrative disputes,this thesis studies the administrative review Committee in order to provide a theoretical basis for its development.The first part explains the purpose and significance of the topic,analyzes and summarizes the research status at home and abroad,and uses a variety of research methods to sort out the relevant contents of the Administrative Review Committee.The second part summarizes the connotation,function and establishment basis of administrative review committee,through the theoretical exploration of administrative review committee,explains the rationality of the establishment of administrative review committee.The third part introduces the main pilot models of administrative review committee,respectively taking the case study of the decision type administrative review committee and the advisory type administrative review Committee,and summarizes the effects of the trial.After trial implementation,the Administrative Review Committee has played a positive role in the number of cases accepted and error correction rate of administrative review.The fourth part,by analyzing the deficiencies of the Administrative Review Committee in the pilot and the deficiencies of the provisions of the Administrative Review Committee in Soliciting Opinions,scientifically recognizes the current predicament of the Administrative Review Committee.The fifth part puts forward the improvement of the Administrative Review committee,mainly in the administrative review committee’s operation mechanism,organizational form and supporting system and other aspects of the improvement.
