In countries with developed market economy,the exploration of business freedom has long been a thing of the past,but it is appropriate to study the protection of business freedom in emerging market economy countries,especially for China,a socialist country in the critical period of diversion.However,the phenomenon of infringing on business freedom in social and economic reality is inexhaustible.Business freedom can be obtained based on policy or lost based on policy.The difficult problem is worrying about the extent to which the state can limit and shrink the space of business freedom without conflict with the principle of free and democratic order.In particular,there are many kinds of state intervention in the market.Some restrictions are justified based on the consideration of various public welfare purposes,while some restrictions are contrary to the operation principle of market economy and have doubts about the legitimacy.At this stage,the lack of government decentralization,the failure of market supervision and the low efficiency of government services lead to the lack of due legal protection for business freedom.With the advancement of the reform,the government and its departments need to mobilize all forces,take various measures to implement the reform measures,and further explore how to not only implement the decentralization,but also balance the relationship between decentralization and supervision,but also improve government services,truly realize "openness,good management and excellent service",and truly realize the freedom of business.Therefore,according to the reform on "deregulation,management and service",rebuild the business environment and realize business freedom: deepen decentralization and stimulate the vitality of market subjects;Promote scientific supervision and create a fair market environment;Improve government services and realize the high efficiency of enterprise operation.The paper is divided into four parts.The first part describes the background of the article,the significance and the study status at home;Chapter one including the notion,types and value of business freedom;The second chapter is an overview of the problems existing in the legal protection of business freedom in China.There are three problems in realizing business freedom under the background of "release,management and service" reform: first,the market access is heavily fortified and the freedom of business entry is suppressed.Second,the administrative law enforcement is not standardized,and the freedom of business execution is limited.Third,the administrative public service is not in place,and the realization of business freedom is not smooth;The third chapter mainly explores the direction of improvement and perfection of the protection of business freedom in China,that is,the reform of "release,management and service",and the legal path of the protection of business freedom in China.Put forward suggestions on improving the legal system from the three aspects of "release","management" and "service",and explore how to implement decentralization and improve supervision on the basis of improving government services.Build a legal path to realize business freedom.
