| With the continuous acceleration of digital information technology,the existing short video digital copyright protection system has more and more serious problems,such as cumbersome authentication of works’ rights and frequent infringement,and difficult to obtain evidence for short video copyright rights in judicial practice.Currently,blockchain technology provides a new way for short video copyright protection with the characteristics of the imtamability of on-chain data.It mainly enables short video copyright protection from three aspects: right confirmation,authorization transaction and rights protection litigation.Based on the actual dilemma of short video copyright protection,this paper expounds the logical basis of block chain technology enabling short video copyright protection.From the practical application of block chain combined with short video copyright,the practical advantages of block chain technology compared with traditional short video copyright protection methods are clarified.At the same time,we sorted out the specific legal norms applicable to the current short video copyright field and clarified the current connection between blockchain technology and legal system.While enabling short video copyright protection,blockchain technology also brings many problems to the traditional copyright legal system and rule system.Firstly,due to the lack of clear legal norms and industry supervision,the technical rigidity in the process of blockchain right confirmation will lead to questions about the copyright certification effectiveness and content originality of short video works,which will lead to the confusion of ownership of short video works.Secondly,in the process of short video authorization circulation under the background of Copyright Law,there is a substantial conflict between the legal privacy protection and modification rights enjoyed by authors and the tamperproof nature of blockchain data,and the shackled between the fair use of short video content and the operation of technology cannot be ignored.Finally,in the application of blockchain in short video rights protection litigation,it is difficult to examine the originality and authenticity of deposited evidence.In addition,the neutrality of third-party technology platform also has a substantial impact on the fairness of copyright rights protection.Therefore,while using blockchain technology to enable copyright protection of short videos,measures should be taken to alleviate the contradiction between technical operation and legal norms.Based on judicial block alliance chain and block chain ecological short video database,a trusted copyright environment based on block alliance chain and short video copyright protection is created.Optimize the relevant legal system and regulatory measures in the field of short video copyright and combine the technology itself to improve the regulation and guarantee function of the law on technology.First,the system of right confirmation and certification is improved,and the substantial content review mechanism of short video works is established in combination with blockchain,to improve the copyright legal norms and supervision mechanism applicable to blockchain right confirmation.Second,improve the system of authorization link,unify the privacy protection norms of the online chain of short video works,improve the coordination between the reasonable use of works and technology application,and build a standardized blockchain works authorization mechanism.Third,improve the system of rights protection litigation,clarify the evidence effectiveness of blockchain storage certificate with judicial credibility,and strengthen the normative supervision of blockchain platform.Through the doubletrack improvement of legal norms and technical content,we will promote the better application of blockchain in copyright protection of short videos. |
