With the comprehensive improvement and development of Internet technology,new business models with platform economy,sharing economy,crowdsourcing economy,and crowdfunding economy as the main models have flourished,providing new momentum for China’s economic development.The number of practitioners in new formats represented by online appointment delivery staff continues to increase,and their rights and interests protection issues have attracted more and more attention,with occupational injury protection rights and interests bearing the brunt.The occupational characteristics of online couriers lead to increased risk of work injury,but contrary to this,they are excluded from the existing work-related injury insurance system premised on labor relations,and cannot obtain timely and effective relief after occupational injuries.How to solve this contradiction as soon as possible and explore an effective institutional framework to provide occupational injury protection for online delivery workers has become a top priority.This paper first defines the four core concepts of new business formats,online appointment delivery staff,occupational injury,and occupational injury protection involved in this research.At the same time,according to the labor market segmentation theory and occupational risk theory,using literature research,empirical analysis,comparative analysis and other research methods,this paper analyzes the basic situation of the occupational injury risk and occupational injury guarantee of online delivery workers in my country,and believes that the occupational injury of online delivery workers in China is Insufficient security,manifested in imperfect labor security,inability to participate in work-related injury insurance,and insufficient commercial insurance coverage.The reason is mainly because the industrial injury insurance system lags behind the development of new business formats,platform workers evade employment responsibilities,and lack of rights and remedies.To establish an occupational injury protection system for online delivery workers,it is necessary to overcome the limitations of labor relations,difficulties in the identification of occupational injuries,the implementation of some payment subjects,the development of occupational injury prevention,and the lack of relief channels.This paper draws on the practices of Germany,Japan,the United Kingdom,and the United States on occupational injuries to informal workers,as well as the exploration of occupational injury protection systems in my country’s Shandong Weifang,Jiangsu Nantong,Wujiang District,Zhejiang and other pilot regions.Difficulties are broken through one by one,combined with the characteristics of "space separation,time division,and relationship differentiation" in the work of online couriers,and suggestions for occupational injury protection for online couriers are put forward.Adhering to the concept of “nationalization” of security,“relaxing” occupational injury protection and labor relations,and improving relevant laws and regulations as the general idea,specific details are carried out in terms of payment subjects,payment rates,occupational injury identification,treatment levels,and work-related injury prevention.System design,to construct the optimal path to realize occupational injury protection for online delivery workers.The payment subject can be paid by platform companies,employees and the government;in the design of payment rates,the“industry differential rates”,"Floating rate";in terms of occupational injury identification,focus on "causal factors",appropriately relax "time factors" and "space factors",and simplify the application process for work-related injuries;in terms of treatment levels,based on work-related injury insurance,make targeted adjustments around payment subjects,payment content,payment methods,etc.;in occupational injury prevention,establish an occupational injury prevention fund,use big data to collect information,and focus on normalized training.
