| The massive use and penetration of digital technology has given rise to many new forms of employment,and the platform economy,represented by online takeaways,has given new impetus to economic growth.However,due to the higher risk of occupational injury,the issue of workers’ compensation insurance for the emerging workforce of crowdsourced online delivery workers has become increasingly prominent.As crowdsourced online delivery workers are characterised by de-labourisation and non-standardised modes of employment,they are currently not fully covered by the work injury insurance system.In order to strengthen the protection of the labour rights and interests of online workers on platforms such as crowdsourced online delivery workers,the author defines the work injury-related aspects of crowdsourced online delivery workers and clarifies the current problems of this group’s participation in work injury insurance,and then improves the construction of a work-related injury protection system that is compatible with them.Firstly,in order to reduce the risk of implementing the system and ensure the integrity and unity of the work injury insurance system,it is suggested that the barrier of work injury insurance being governed by labour relations be appropriately broken down,and that the Work Injury Insurance Regulations be amended to include online workers on platforms,such as crowdsourced online delivery workers,in the scope of work injury protection.In order to avoid the substantial injustice caused by the complete "same work and same insurance",special provisions should be made for "platform online workers" as a new section of the Work Injury Insurance Regulations,and design innovations should be made in the construction of the specific system of work injury insurance.In terms of work injury insurance contributions,for the large number of crowdsourced online delivery workers with flexible employment,the contribution model of five insurance levies should be changed to allow priority to be given to separate payment of work injury insurance fees.The main contributor should be the employment platform and should be obliged to pay contributions.The contribution base should be based on the monthly personal commission of the crowdsourced online delivery workers,and should be topped up by the state treasury when their commission income does not reach the lower limit of the contribution base.The contribution rate is based on the basic rate for industries with a similar level of injury risk as the takeaway delivery industry,and is adjusted downwards according to the incidence of work-related injuries and the use of work-related insurance costs.In order to explore the new context of the application of work injury insurance for crowdsourced online delivery workers under the new employment pattern,the criteria for work injury recognition can be appropriately relaxed,and the method of work injury recognition can be innovated by changing the pre-application system for work injury recognition,etc,to reduce the difficulty of work injury recognition.With regard to the payment of work injury treatment,the work injury insurance fund and the employing unit are still the main subjects of payment of work injury treatment.However,in view of the special nature of the platform’s employment model,some of the treatment items paid by the employer are transferred to the work injury insurance fund,and appropriate adjustments are made to the standards of the treatment items,and innovations are made to the way the treatment is paid.Secondly,the protection of labour rights and interests of crowdsourced online delivery workers will be strengthened through the construction of a multi-level occupational injury protection system,the establishment of trade union organisations and the building of a unified work injury insurance service platform. |
