| Since the 1970 s and 1980 s,countries around the world have gradually begun to pay attention to environmental issues and become aware of the irreversible effects of climate problems.1992 marked the introduction of the United Nations Framework Convention on Climate Change(UNFCCC),which brought climate issues into the scope of national laws to be regulated.The subsequent Kyoto Protocol,which represents the international community’s attempt to mitigate climate change through mandatory emission reduction actions,ultimately failed due to the overemphasis on differentiated responsibilities and the lack of reasonableness of the emission reduction targets set.In 2015,the adoption of the Paris Protocol broke the deadlock in global climate governance since the Kyoto Protocol by reconstructing the principle of common but differentiated responsibilities,requiring all parties to make flexible and autonomous commitments to reduce emissions according to their national circumstances.In order to mitigate the risk of uncertainty arising from the flexibility of compliance by each Party,the Paris Agreement establishes an innovative compliance model: first,with the core of autonomous national contributions,Parties are required to declare their emission reduction commitments;second,with a transparency framework as a guarantee of operation,Parties are required to report timely and accurate information on the implementation of emission reduction actions and other relevant information to enhance mutual understanding and trust among Parties;and third,with a compliance mechanism to promote compliance.Third,the compliance mechanism is used to promote compliance and implementation by investigating the causes of non-compliance and helping Parties to resume compliance through the facilitative compliance mechanism;fourth,the global inventory is used to urge countries to enhance their actions by continuously tracking the actual implementation status of countries,estimating the gap between the actions taken and the final target,and requiring Parties to continuously enhance the level of autonomous contributions to ensure the final target.To ensure the achievement of the ultimate goal.However,due to the existing regulations are too coarse,the Paris Agreement still has the problems of weak legal binding force of national autonomous contribution,lagging transparency framework,insufficient enforcement power of compliance mechanism and weak reference of global inventory conclusion,and it is urgent to improve the relevant implementation rules as soon as possible.After analyzing the existing mechanism arrangement and logical design of the Paris Agreement,this paper proposes the compliance model of the Paris Agreement focusing on the obligation of national autonomous contribution,information reporting obligation and the setting of compliance mechanism,respectively.Finally,China,as one of the parties to the Paris Agreement,should actively implement the agreement,deeply participate in international climate negotiations and global climate governance,and grasp the power of negotiation and rule-making.To this end,China should,on the one hand,adhere to its position as a developing country in deepening its participation in global climate governance,continue to promote the concept of a community of human destiny,and actively submit its own national contributions while taking into account its own development interests;on the other hand,it should continuously strengthen its own capacity building by improving domestic legislation in the field of climate response,regulating the domestic carbon market trading mechanism,and improving the greenhouse gas emission disclosure system,and using On the other hand,we should continue to strengthen our own capacity building by improving domestic legislation in the field of climate response,regulating the domestic carbon market trading mechanism,improving the greenhouse gas emission disclosure system,and using legislation to accelerate the transformation of domestic law into the obligations of the Paris Agreement,so as to continuously improve the level of our national autonomous contribution.In addition,it is necessary to vigorously develop clean energy technologies and optimize the energy structure to solve the problem of high carbon emissions at the root. |
