| The restriction and abolition of the death penalty has always been an issue of great concern to the international community and Chinese academic circles.In the early 21 st century,the voice of restricting the application of the death penalty and respecting and protecting human rights has become louder and louder.China formulated and improved China’s criminal code at the end of the 20 th century,but there are still many disputes about the death penalty system.Through case introduction,this paper leads to some problems existing in China’s current death penalty system.By comparing the development of the world death penalty system and China’s death penalty system,this paper obtains the problems existing in China’s death penalty system,then analyzes the causes of the problems and looks forward to the development trend of China’s death penalty.With the current construction of China’s society ruled by law,the existence of the death penalty is becoming more and more inhumane.However,since the complete abolition of the death penalty is not possible in China,we can abolish the statutory death penalty for some crimes in legislation,restrict the application of some death penalty crimes in judicature,and gradually improve China’s death penalty system. |
