| With the rapid development of China’s economy,social conflicts are becoming increasingly complex,and the people’s demand for justice is also growing.As a national judicial organ,the court is the front position and main force to resolve social conflicts and disputes.Judges are the main force in the trial work.The performance of judges determines the quality and efficiency of court trials,and affects the realization of the goal of judicial justice and efficiency.In recent years,with the deepening of the post system reform,although the construction of the judge team has made some progress,the effective incentive mechanism within the court is insufficient.Under the heavy trial task and high workload of work pressure,the phenomenon of professional burnout of judges is more common.The loss of judges is serious,and the improvement of the trial quality and efficiency is limited,which has seriously affected the people’s sense of access to justice.It is of great theoretical and practical significance to strengthen the research on the problem of judges’ motivation and explore solutions to the problem,so as to fundamentally stimulate the enthusiasm and creativity of judges and improve the quality and efficiency of court trials.This study takes the judge incentive mechanism after the post system reform of the courts in District B of City A as an example,and uses the author’s work advantages to conduct a comprehensive study and analysis of the data obtained from the field survey by using the methods of literature research,case study,questionnaire and interview.The investigation found that there are still some problems to be solved in the judges’ incentive mechanism of District B courts,such as unscientific assessment methods,lack of reasonable and smooth promotion channels,imperfect professional security,lack of court culture incentives,which seriously damaged the enthusiasm and enthusiasm of judges,caused the loss of some judges,and affected the stability of judges.Based on the theory of demand level,the theory of double factors and the theory of fairness,this paper deeply analyzes the reasons for the problems in the judge incentive mechanism after the reform of the post system in District B courts.The main reasons are that the performance appraisal mechanism is unreasonable,the traditional personnel management concept is backward,the people-oriented management system is not perfect,and the cultural incentive mechanism is not perfect.On the basis of drawing on the advanced experience of developed countries,this paper puts forward the basic path to improve our judges’ incentive mechanism under the background of post system reform: first,optimize the judges’ performance appraisal system,second,improve the judges’ promotion system,third,improve the judges’ professional security system,and fourth,strengthen the construction of the court culture incentive mechanism. |
