| Artificial intelligence techniques have been applied in every aspect of life.Nowadays,the emerging thing of pilotless automobile has also emerged with the development of technology.Many Internet giants and traditional auto companies have also begun to study the latest autonomous driving technology,hoping to gain a place in the future car market with driverless technology.However,pilotless automobile are different from the driving mode of traditional motor vehicles,and the driving action is completely controlled by the autonomous driving system,which will lead to the transfer of the subject of risk burden,and the compulsory traffic insurance system,which plays an important role in the automotive industry chain,will bring new challenges due to technological innovation.There are many problems in the identification of legal attributes of driverless cars,the subject of accident responsibility,and insurance compensation.Based on this,the compulsory traffic insurance system must be timely reformed to promote the further development of driverless cars.Although most pilotless automobile are still in the road testing stage and there is still some time to go before they can be mass-produced on the road,developed countries such as the US,THE UK,Germany and Japan have already put the revision of regulations on pilotless automobile on the agenda and enacted corresponding laws.Germany was the first to define the scope of liability for driverless accidents and made more detailed provisions in the Road Traffic Safety Law.However,Britain is the country that formulated the automobile insurance standard earlier in the world.In its "AEV Act",it has made comprehensive and detailed provisions on the insurance liability and claim limit of unmanned vehicles.Although Japan had not issued formal legal documents at that time,but some insurance companies had formulated the corresponding insurance claims provisions,the legislative measures of the above-mentioned countries provided an important basis for China’s compulsory insurance system.This In the first chapter,the definition of pilotless automobile,the exploration process of various countries in the world,the classification of classes,the differences with traditional motor vehicles,and the theoretical basis of the reform of China’s compulsory traffic insurance are comprehensively discussed.The second chapter introduces in detail the problems existing in the application of pilotless automobile to the current compulsory traffic insurance system.The control of the car is transferred from the driver to the automatic driving system,which will impact the current compulsory traffic insurance system and lead to a series of problems.For example,the liability subject is developing to diversification,the current liability principle of traffic accident cannot be applied,and the transformation of driver to "passenger" identity is not guaranteed by compulsory traffic insurance.The third chapter introduces relevant liability insurance systems abroad and then provides enlightenment to the reform of China’s pilotless automobile compulsory insurance system.On the basis of the existing legal framework,specific reform paths for specific insurance liability subjects,insurance holders and insurance claims are proposed in Chapter 4 to promote better connection between pilotless automobile and current compulsory insurance. |
