Abstract/Summary:
The construction of occupational injury risk and protection for new employees is one of the signs of social progress and development.At present,there are about 200 million flexible employees in China,and most of them are new-format employees.However,the labor relationship between new-format employees and employers is unclear,and the current occupational injury risk protection system and labor protection mechanism are difficult to meet the needs of new-format employees,so the occupational injury risk protection is in a vacant state.What are the occupational injury risks faced by new employees? What are the factors that affect the occupational injury risk of the employees in the new format? How to improve the occupational injury risk protection of the new business employees and establish a fair and reasonable occupational injury risk protection system for the new business employees?This series of problems need further scientific research.Based on literature research,comparative study,questionnaire survey and interview,from the perspective of risk society theory,Maslow’s demand theory and government intervention theory,this paper analyzes the occupational injury risk of new-format employees with obvious risk characteristics,such as take-away riders and online car drivers,from four aspects: risk awareness,labor relations,government supervision and system construction.This paper finds that,firstly,the propaganda work of occupational injury risk protection system policy is not in place,the awareness of the policy needs to be improved,and the new business enterprises pursue short-term economic effects,and their willingness to participate in insurance is not high.The risk awareness of the new employees and enterprises is weak;Secondly,the solidification of the definition of the labor relations of the employees in the new format and the deliberate neglect of the establishment of the labor relations by the enterprises in the new format lead to the ambiguity of the labor relations;Thirdly,it is difficult for government departments to supervise under the new economic mode,and the supervision system of government departments is not suitable for the employment mode under the new economic mode;Fourthly,the occupational injury risk protection system for the new format employees is still in the exploratory stage,and the imperfect design of the system system makes the risks of the employees worse.The research shows that we should optimize and improve the occupational injury risk protection for the employees in the new format.The following four measures can be taken.First,the government should intervene to enhance the risk awareness of new business employees and enterprises through policy propaganda,financial subsidies and occupational injury prevention.Second,clarify the labor relations,explore a special occupational injury risk protection system for new-format employees that can be separated from the labor relations,and prevent and resolve the occupational injury risk;Third,further strengthen the government supervision function,clarify the platform responsibility,and establish a strong government supervision system;Fourthly,we should establish a reasonable identification standard of occupational injuries,strengthen the construction of laws and regulations and scientific system design,and effectively help the new-type employees to cope with the risks of occupational injuries.The research of this paper is helpful to provide reference significance for the improvement and optimization of the occupational injury risk protection system for the new business employees.
