In recent years,time-sharing,as a new way of tourist consumption,has already become a kind of mature recreational holidays which has been highly regarded all over the world.In China,it has entered a fast track of development after winding exploration in early years.Today,innovations basing on time-sharing model are beginning to emerge in other areas.The phenomena of ownership of timeshare,which is multiple ownership in the same object of ownership rights kind of time-sharing,have come into view.Therefore,the time-sharing ownership system of this article means an ownership system of multiple belonging to distinguish times on the same object,taking time-sharing products as an example.As the system of time-sharing ownership is a novelty,this article is mainly about the justification of it from the real needs and the theoretical foundation.The article is divided into four parts.The article focuses on the grounded theory of this system implied by property law and the impact on the traditional theory that adopted in historical approach.First of all,the article puts forward the development situation of the system of time-sharing ownership to show the real needs.By carding its formation and development,in addition to the legal regulation,the article finds that joint ownership in share is inapplicable.It is necessary to build a new system of time-sharing ownership.After that,the article identifies the nature of time-sharing ownership and can be supposed as time-limited or term-limited ownership rights.The article also analyses its legal characteristics and legal nature.Secondly,the article makes a theoretical analysis of the system of time-sharing ownership to justify the rationale.Starting with dual ownership,the article found that timeshare as a new type of ownership dose not lead to disorder.It’s more the idea that the theory of relative ownership provides theoretical support for time-sharing ownership.And the article believes that the conception renewal of ownership can create the space for constructing system of time-sharing ownership.Thirdly,the article points out the system of time-sharing ownership’s influence to the theory of traditional ownership.On the one hand,the features of the right of time-sharing,like time-limited,will impact on the concept of absolute ownership.And it will break the statutory principle of property rights to bring forth new ideas on types and contents of property.On the other hand,it also introduces innovative connotation to the traditional ones.Time-sharing could be regarded as a new model of joint ownership and provide more possibility for real estate’s usage.It is a development and renewal of joint ownership and real property right system.Finally,the article proposes the ideas about Chinese time-sharing ownership system construction.Furthermore,the article divides the system into two parts:time-sharing ownership of chattel and that of real property.The system of chattel time-sharing should focus on governing the contract of timeshare.And the point of time-sharing ownership of real property is property publication.The article provides some ideas for improving the registration system.
