Research On The Government Supervision Of Car-sharing

Car-sharing is the specific performance of the shared economy in the field of transportation,including the Car2go time-sharing rental model and P2P car rental mode.Among them,the Car2go-style car rental can be divided into the light assets mode which mainly provides operation service and the heavy-asset model which owns the vehicle ownership.In essence,different operation modes bring about the difference between the legal nature of the enterprise and the responsibility it should bear in the market behavior.At present there is no national law to regulate shared cars in our country.The local governmentsundefined policies and regulations are mainly directed and encouraging policies,and the compulsive power is weak and the difference is obvious,and the policies and regulations of local governments are mainly directed and encouraging policies,and the enforcement power is weak and the difference is obvious.It is difficult to effectively regulate the conflicts of interest and legal problems existing in the process of its development,so this article through the analysis of the existing legal regulation of the shared automobile industry,to explore the regulatory thinking and regulatory path to adapt to the characteristics of its industry development.In order to ensure the orderly development of its market,and through the rationalization of the regulatory system and supporting policies to establish,fully improve the use of new energy vehicles,idle private cars,roads,parking points,public charging piles and other resources utilization efficiency,Solve the problem of "last kilometer" trip.The first part of this paper is the introduction,mainly introduces the research ideas and objectives of this paper.The second part of this paper discusses and analyzes the current situation of shared vehicle operation and its research status at home and abroad.At present,the theoretical research of Chinese scholars mainly focuses on the traditional car rental industry and the research on the operation and supervision of network rental car under the concept of shared economy,few of them deeply discuss the new travel mode of shared car,which is a new type of travel mode,which is based on the traditional car rental industry and the concept of shared economy.Its theoretical basis provides some ideas but also has limitations for the study of shared vehicle supervision.Therefore,how to combine the existing theoretical research to design the legal supervision system of shared automobile is also an urgent problem to be solved in this paper.In the third part of this paper,the theory of shared automobile operation and supervision is analyzed,and the contradiction between the existing management system and operation mode is analyzed and discussed based on the characteristics of the new economic form of shared economy.The fourth part of this paper,on the basis of the previous article,analyzes the current situation and existing problems of the legal supervision of shared cars in our country,on the one hand,it analyzes the status quo of the whole supervision at the national level;On the other hand,through the interpretation and comparison of the regulations at the local level,and through the analysis of the supervision ideas of the local governments,this paper summarizes the existing supervision ideas and the problems existing in the supervision system.In addition,although there are few regulatory measures for the shared automobile industry in China as a whole,there is a relatively systematic regulatory system for both the traditional car rental industry and the online car-hailing industry,which also relies on the development of the shared economy.Therefore,we can make a comparative analysis of the existing problems of its regulatory system,and draw lessons from it.The fifth part of this paper,based on the problems existing in the supervision of the shared automobile industry,puts forward the perfection of the legal system,the supervision measures and other supporting systems,and puts forward the optimization direction to the supervision ideas,the supervision contents and the establishment of the supervision system.
