Exploration On The Application Of Tibetan Ethnic Customs In Dispute Resolution

In the process of building a rule of law society in China,ethnic customs,village rules and people’s covenants and existing legal norms are important components of the dispute resolution mechanism in ethnic minority areas.Taking Tibetan ethnic customs as the starting point,starting from the perspective of the organizational characteristics of Tibetan society and the natural environment,through academic analysis and legal sociology interpretation,the content,origin and inheritance of Tibetan ethnic customs are analyzed and summarized,the application status,application dilemma and application value of Tibetan ethnic customs in dispute resolution are analyzed and studied.The operation mechanism explores the dispute resolution mechanism from the perspective of ethnic tradition and modernity,constructs diversified dispute resolution methods suitable for the real state of ethnic minorities in today’s society and culture,puts forward feasible opinions and plans for improving the ability of ethnic dispute resolution,and gives full play to the positive role of ethnic customs in dispute resolution in ethnic areas,so as to effectively resolve conflicts and disputes in ethnic areas,and further improve the governance capacity and governance level of ethnic areas in China.
