With the development of the information revolution,electronic information technology has developed rapidly,giving rise to a profound change in human society.The judicial system is no exception,gradually embarking on the road of informatization.Electronic service of process as an important part of the construction of judicial information technology,in line with the trend,to meet the growing demand for civil litigation service,effectively improving the success rate and efficiency of service of process.However,as the reform progresses,the electronic service system also reveals some problems.In order to make the electronic service to better adapt to the development of the times,to promote the electronic service system more perfect,this paper deliberately choose the civil litigation electronic service problem for research.By consulting relevant information,clarify the connotation of electronic service,the main features,specific types and value pursuit of the basic theory,and then the electronic service of process system in foreign countries for reference,and finally the evolution of electronic service of process in China to sort out,found that China’s electronic service of process system on the legislation is more principled,the provisions are not detailed and clear,easy to lead to confusion in judicial practice.Therefore,this paper selects the civil litigation electronic service of process system in the object of service,party consent rules and three aspects of the effective time of the instrument to explore the study,starting from the case,summarize the focus of controversy,discuss the legal issues reflected,and then analyze the relevant doctrine of the academic community,theory and practice,combined with case analysis and comparison,and finally put forward the civil litigation electronic service system to improve the proposal.
