Research On The Principle Of Restriction On Citizens’ Basic Rights In Public Health Emergencies

The development of science and technology has made global exchanges more frequent and the spread of viruses more rapid,which has led to the globalization of the risk of infectious diseases and evolved into a global public health emergency.Although risks are unavoidable,the country’s response is based on human and reflects the country’s governance level.Just as Heller believes that the two pillars of modern ethics are a just constitution and the decency of modern people.Facing the threat of public health emergencies,the biggest difference between a civilized modern society and other non-modern societies is that it can whether to use the power of the rule of law to resolve crises.The COVID-19 has seriously affected people’s lives.In order to curb the spread of the epidemic and reduce losses,China has adopted measures such as suspension of work and production,isolation,and city closures,making China with the least number of deaths and the smallest losses due to the COVID-19,and successfully guaranteed the safety of most people,which is a major manifestation of the success of the rule of law in China.However,this is also a major challenge to China’s governance system and governance capabilities on issues like restriction of the basic rights of citizens;state organs and their staff have illegal and unreasonable restrictions;illegal behaviors such as citizens making rumors or beating law enforcement officers,which all have exposed the legality and reasonableness of the response methods and the citizens’ awareness of the rule of law.Under normal circumstances,restricting the basic rights of citizens will not cause direct losses to the country,but to citizens,it means that the rights and interests of citizens will be damaged.Therefore,the restriction shall be legal and reasonable and be limited to urgent and unavoidable situations.Citizens should also consciously improve their awareness of the rule of law,they shall cooperate and supervise the country’s law enforcement behavior in such situations,and jointly promote the country’s legal construction.Based on this,this article will combine the actual situation in the COVID-19 prevention,aiming to explore the improving methods for the relevant legal system in accordance to theory and practice of the principles and methods of restricting the basic rights of citizens in public health emergencies and improve citizens’legal awareness and awareness of the rule of law,hoping to perform better when deal with epidemics and even public health emergencies in legal way and build a stable and good relationship between state agencies and citizens to achieve more efficient risk prevention and controlling,and at the same time promote the modernization of China’s national governance system and governance capabilities.
