Research On The Protection Of Civil Rights In Public Health Emergencies

The outbreak of a globalized epidemic in 2020 has brought unprecedented challenges to mankind.This disaster has caused great pain to mankind,and at the same time it has also caused extensive and in-depth reflection.Faced with the raging disease,the Chinese people were determined to overcome the epidemic and faced difficulties.As public health emergencies inevitably make the exercise of citizens’ rights subject to greater impact,attention to the protection of citizens’ rights under public health emergencies has become the subject of legal research.How to protect the rights of citizens under special circumstances and promote and maintain the spirit of governing the country according to law is especially worthy of our deep consideration.This article takes the protection of civil rights in public health emergencies as the starting point,introduces and analyzes some thoughts that COVID-19 brings to me from different angles and levels.At the same time,combining the principle of proportionality,the theory of the rule of law,and the principle of the rule of law based on interest considerations,clarify what rights citizens should enjoy in public health emergencies? How are these rights protected?According to domestic reality,we learn from the shortcomings and lessons of foreign anti-epidemics,and propose suggestions from four aspects: legislation,law enforcement,legal relief,and legal supervision.The purpose is to explore how humans can strengthen the protection of civil rights in the face of public health emergencies,so as to promote the cause of human rights development.
