Research On The Responsibility Boundary Of Government Under The Rule Of Law In The Context Of Carbon Neutrality

Climate warming has become a recognized environmental issue.The "greenhouse effect" caused by carbon dioxide emissions from human activities has seriously affected the natural environment,agricultural ecology,and human survival space.Human beings are facing very serious development issues.Therefore,the work of "carbon emission reduction" brooks no delay,and the global goal of "carbon neutrality" emerged as the times require.Its emergence has combined "carbon compensation" and "carbon emission reduction",providing a basic concept for low-carbon action in various countries.The "carbon neutral" governance system is multidimensional,comprehensive,and comprehensive.Only by placing it within the framework of the rule of law can we effectively resolve the deep-seated interest related issues therein.In the carbon neutral legal system,the government plays a crucial role and occupies a leading position.On the one hand,the government led governance model can easily form a "government dependent" responsibility system,making the government assume unlimited responsibility while possessing administrative powers.On the other hand,because the definition of government responsibility in the law remains in a principled framework,and in practice,due to the lack of specific enforceable rules,the boundaries between the division of government powers and responsibilities are unclear.When multiple entities participate in governance activities,the government will instinctively choose low-risk and less accountable administrative actions to evade responsibility.Therefore,it has significant practical and theoretical significance to carry out research on the boundaries of government responsibility under the rule of law and carbon neutrality.This article takes the government responsibility in the process of carbon neutral rule of law as the starting point.Firstly,through analyzing the current situation and existing problems of government responsibility in the process of carbon neutral rule of law in China,and then based on this,from the perspective of administrative law,it sorts out and classifies the reasons for the ambiguity of the government responsibility boundary,and finally summarizes the path to clarify the government responsibility boundary,and puts forward suggestions for establishing and improving the government responsibility system and the "carbon neutral" multiple governance system.
