Research On The Administrative Law Regulation Of Live Streaming Sales

Falsification of popularity and traffic data in the live broadcast room,false publicity,shoddy goods,price chaos,lack of after-service and tax evasion etc.,which are frequently exposed by live streaming sales,violate the legitimate rights and interests of consumers and disrupt the market at the same time.In the final analysis,the emergence of these problems is due to the imperfect regulatory basis and the relative lag of regulatory measures.At present,my country’s civil law and criminal law are obviously lacking in the standardization and systematization of related laws such as live streaming.More flexible administrative laws and regulations can better make up for this deficiency.Through sorting out the laws and normative documents related to the current live streaming sales,it is found that there is no special administrative law to regulate the live streaming sales in my country.The relevant laws and regulations are too low,the administrative regulation system is not perfect,and the regulatory subjects overlap.,Outdated regulatory concepts and other issues.In this regard,drawing on the relevant experience of foreign webcasting,put forward an updated regulatory concept,improve the administrative normative system for live streaming sales,establish the main body of administrative law regulation for webcasting with goods,and improve the administrative law regulation system for webcasting with goods.To ensure the healthy and orderly development of my country’s online live streaming on the road of the rule of law.The paper consists of five parts.The introduction part tells the background and significance of this research,comprehensively summarizes the research status at home and abroad,and the specific research methods used in the research process.The second part discusses the concept and characteristics of webcast and its administrative law regulation respectively,and expounds the necessity of strengthening the administrative law regulation of webcast.The third part points out main problems existing in the regulation of live streaming administrative law of carry-on based on current legislative situation of our country.The fourth part summarizes the experience and inspiration of live broadcast administrative law regulation in the developed countries.The fifth part,aiming at the problems existing in the administrative law regulation of network live broadcasting,provides feasible measures for the further improvement of administrative law regulation.
