Digital transformation is profoundly affecting our lives.Digital technology makes personal information fully digital.As an important part of data elements,personal information has brought huge positive benefits.The following illegal handling of personal information makes personal information security risks increasingly elevated.Personal information is not only related to citizens’ personal privacy and information security,but also related to national security and social public interests.The protection of personal information reflects the respect for human rights and democratic policy system.The traditional personal information protection mode focuses on the protection of personal privacy and personality rights,and focuses on relief after the event.The digital era is a multi angle protection of personal information rights and interests,requiring process protection and prevention first.Personal information includes personal interests,economic interests,and public interests,which promote and restrain each other,which determines the integrity and versatility of personal information protection.In recent years,although the state frequently issued various regulations to strengthen the protection of personal information,illegal processing of personal information is still repeatedly prohibited,and the difficulty of prevention and control has increased dramatically.The Personal Information Protection Law of 2021,a special law,requires protection as the core and promotion of rational use of personal information.The government work reports in 2021 and 2022 for two consecutive years have emphasized the protection of personal information.Based on the theory of holistic governance,the author proposes the direction of integrating and coordinating personal information protection measures,from improving administrative regulations,unifying law enforcement standards,establishing special personal information protection institutions,strengthening market entities to implement personal information protection responsibilities,building public databases Make full use of digital technology to improve personal information protection countermeasures.This paper is based on the national data survey on personal information protection conducted by the Cyberspace Administration of China,the CNCERT/CC and other units,and through the research on the status quo of the subject,norms,protection behaviors and violations of personal information protection,it analyzes and summarizes the difficulties and reasons of classic cases.To solve the problem of personal information protection,the first step is to start from the personal information itself,and protect the personal information by classification and quantification,so that the personal information protection is easy to operate digitally both from the management level and the technical level,and reduce the confusion of law enforcement and the misunderstanding of technical design on normative documents;Then,from the perspective of unified administrative supervision norms,it is proposed to formulate the supporting administrative law enforcement normative documents of the Personal Information Protection Law to make up for the shortcomings of decentralized law enforcement and expand the scope of supervision;Then,from the perspective of the specific operation of administrative supervision responsibilities,it is proposed to establish a special personal information protection agency to take full responsibility for personal information protection and improve the strength and depth of supervision.It is also proposed to establish a national public database of personal information to give full play to the advantages of digital management;Then put forward some suggestions on the implementation of personal information protection responsibilities of a wide range of market subjects,such as establishing the personal information protection principal system,strengthening the special protection obligations of large platforms,strengthening enterprise self-discipline,etc.,which can effectively reduce the probability of personal information infringement;Of course,as the source of personal information protection,the information subject should improve the protection awareness and ensure the exercise of rights such as public complaints and reports,which is an important and necessary measure to regulate the behavior of public and private sectors,achieve public supervision and curb illegal acts.On the premise of satisfying personal information security,national data sovereignty and public interests,promoting personal information sharing,utilization and digital economy development is an inevitable topic of personal information protection.The hot issue of personal information arises from the development of digital technology,and the protection of personal information ultimately needs the help of digital technology to run through the whole process of protection.Finally,with the continuous progress of the society,personal information protection is not achieved overnight,and relevant protection measures also need to be updated and improved.
