| As an important part of the modernization of Chinese governance,grass-roots governance has always been concerned and studied by people.And villager self-governance is exactly one of the important ways to realize the grass-roots governance.Since the implementation of the Organic Law of the Villagers Committee for more than 30 years,the realization of grass-roots democracy can be said to be the main research direction of scholars.The report to the 19 th CPC National Congress proposed "implementing the rural revitalization strategy" and called for "strengthening basic rural work at the grassroots level and improving the rural governance system that combines autonomy,rule of law and rule of virtue".The report of the Party’s 20 th National Congress also proposed to "comprehensively promote rural revitalization","actively develop community-level democracy",and called for "improving the mechanism of community-level self-governance under the leadership of community-level Party organizations,strengthening community-level organizational construction,improving the system of community-level direct democracy and its working system,and enhancing the effectiveness of self-management,self-service,self-education and self-supervision of urban and rural communities".The above is not only an important part of implementing the rural revitalization strategy,but also a major strategic plan for modernizing the country’s governance system and capacity,which is of far-reaching significance.At present,a series of new policies for deepening rural reform have been introduced and implemented.Reform of the agricultural management system,the rural land system,and the collective property rights system are the pillars of rural reform.Accelerating and improving the villager self-governance system and the rural governance system,which involve administrative management,public services,economic development and social management,should be a major task in the implementation of the rural revitalization strategy,and should also be the shared responsibility of governments at all levels and relevant departments.This paper explores a series of legal problems in the process of grassroots democratic election under the villagers’ self-government,uses Marxist democratic election theory,public choice theory and other theories,takes a town in the western region of Heilongjiang Province as the object of investigation to collect relevant data,and points out the existing problems of this system at the present stage after sorting out the survey data.From the lack of driving force of villagers’ participation,weak sense of democratic power,opaque election procedures,rural elites control the voting rights,supervision mechanism is absent,The main body of supervision has no existence,the idea of clan is more prominent and the intervention of the "two committees",the relationship between the township government,the party branch and the village committee is not coordinated,the game between the village people’s committee and the town government,the game between the villagers,the village people’s committee,the village party branch and the town government,the narrow way of democratic relief and so on.Finally,it puts forward some measures to perfect the villager self-government system in our country,to guide and cultivate the villagers’ democratic consciousness,enhance the public participation,standardize the villager election procedure,publicize the election information,optimize the voting process,standardize the democratic supervision procedure,widen the channels of democratic supervision,further coordinate the relationship between the villager committee and the township government and the village party branch,and increase punishment of the illegal activities.We will improve the recall system,improve the laws and regulations on grassroots elections,and strengthen the legal education of villagers,so as to solve the new problems arising in the construction of grassroots political democracy in China in the new era,effectively raise the level of rural governance,and fully implement the rural revitalization strategy. |
