Research On The Civil Law Protection Of Voice Rights In China

With the continuous development of domestic economy and the continuous update of information technology,the number and types of civil disputes that occur in the daily life of the public have increased,especially under the general environment of the continuous improvement of public legal awareness and the rapid development of new technologies such as artificial intelligence,some provisions in the General Principles of the Civil Law have lagged behind,and legal gaps have become increasingly prominent.In order to better solve civil disputes,the Civil Code of the People’s Republic of China was officially implemented on January 1,2021,and many of its provisions are epoch-making.Article 1023 also passed legislation for the first time to protect the voice of natural persons,which is one of the contents of personal interests,and is protected by referring to the relevant provisions of portrait right protection.In recent years,disputes over the sound protection of celebrities such as Li Jiaqi and Lin Chi-ling have arisen one after another.The proposal of "sound right protection" in the Civil Code meets the needs of the society.However,if the sound right is defined as an independent personality right,it will be more helpful to comprehensively protect the sound right.This paper mainly expounds the research background and significance of voice right protection.Through studying the relevant domestic and foreign legal provisions and papers,it focuses on the concept,nature and legal characteristics of voice right,and analyzes the necessity and problem dilemma of voice right protection.Finally,taking the issue as the guide,it clarifies the property value of voice right We should improve the commercial protection mode of voice rights and clarify the standard of compensation for damages of sound rights.All in all,the provisions of the Civil Code have made up for the legal gap in the protection of voice right to a certain extent,but from the perspective of jurisprudence and practice,the current provisions are not enough to completely protect voice right.This paper focuses on the legal protection of voice right as an independent personality right for reference.
