Research On The Legalization Of Rights And Interests Protection For Rural Family Planning Families In China

In the 1980s,China began to implement the family planning policy of"encouraging one couple to have one child".After more than forty years of application,it effectively controlled the rapid population growth at that time,and family planning families made outstanding contributions to China’s economic and social development.However,during the implementation of this policy,some rural families are in a weak position in terms of family development and income increase.In order to help such families,China has issued a series of incentive and assistance policies.However,due to the limitations of legislation,they still face serious problems of providing for the aged,limited family development ability and poverty.Therefore,the research on the legalization of the protection of the rights and interests of rural family planning plays a very important role in promoting the process of legalization in China and ensuring the development of rural family planning.In order to solve the current practical dilemma and give full play to the due role of the rural family planning rights protection system,this paper is divided into four chapters to discuss.The first chapter is the basic research on the legalization of rural family planning rights and interests protection.This part focuses on the practical basis and theoretical basis of the protection of family rights and interests in rural family planning,laying the foundation for subsequent analysis and demonstration.The second chapter is the legal process of protecting the rights and interests of family planning in rural areas.This part summarizes the emergence and development of the legalization of rural family planning rights and interests protection,that is,the embryonic stage,the exploration stage and the shaping stage,and makes it clear that the legalization of rights and interests protection is characterized by the combination of normative documents within the party and government,decentralized legislation,relatively frequent legislation,from pilot to perfect promotion.The third chapter is the subject,content and procedure of protecting the rights and interests of family planning in rural areas.This part discusses the system content from three aspects:guarantee subject,guarantee content and guarantee procedure.The fourth chapter is the problems existing in the protection of family rights and interests in rural family planning and suggestions for improvement.This is the research focus of this paper.Based on the current effective normative documents and judicial practice,this paper deeply analyzes the problems such as the great differences in reward and assistance policies and the imperfect rights protection mechanism at the system text level,and deeply analyzes the reasons for cases such as property disputes in judicial practice,and analyzes the problems of scattered legislation and excessive authorized clauses reflected at the current system operation level.Finally,on the basis of theoretical argumentation and empirical research,By formulating the Regulations on the Protection of the Rights and Interests of Rural Family Planning,doing a good job of policy convergence in many aspects,strengthening the foresight and comprehensiveness of legislation,limiting the discretion of local governments and other measures,the existing predicament can be solved by the rule of law,in order to achieve the dual goals of improving the relevant rights and interests protection system and the happiness of rural family planning.
