Benefiting from the digital economy and mass communication,We-media advertising has boomed.However,a great number of illegal and irregular behaviors of We-media advertising have emerged simultaneously,such as the lack of advertising disclosure and false propaganda.These behaviors not only damage the market but also violate the rights and interests of consumers.The current legal regulations about Wemedia advertising have a certain lag,which brings difficulties to market regulation,judicial application,and so on.In this regard,it is necessary to clarify the concept of Wemedia advertising and sort out the existing problems so as to offer reasonable suggestions on the legal regulation.This paper is divided into four chapters.The first chapter identifies the concept of We-media advertising,outlines its characteristics,introduces typical cases,clarifies the current legislation and regulation,and points out the existing legal deficiencies and weaknesses in regulation.Based on the analysis of real cases,the second chapter points out the existing problems and causes of the legal regulation.At the legislative level,there are problems such as unclear boundaries between advertising and non-advertising contents,failure to ensure the authenticity of advertisements,inadequate disclosure of the nature of advertisements,and confused identities of persons responsible;and at the regulatory level,there are problems such as excessive discretion of law enforcement authorities in punishing illegal advertisements.The third chapter investigates the current legislation in foreign countries,including the United States,the United Kingdom,and Europe,and draws on three aspects: legal regulation,industry selfregulation and supervision,and penalties for inadequate advertising disclosure.The last chapter gives suggestions to boost the legal system of We-media advertising,including perfecting legislation related to We-media advertising,improving the supervision system of legal application,and increasing consumer prevention and remedy channels. |
