Research On Government Regulation Of Sports Lottery Industry

With the development of China’s economy and the increase of national income level,the sports lottery industry has also developed,and behind the increase of sales year by year,a series of social problems such as"problematic lottery players,underage lottery purchases,Internet lottery sales,and the proliferation of private lotteries" have also arisen.The original purpose of sports lottery is to raise social welfare funds for the state and promote the development of social welfare.The public welfare attribute is the basic characteristic of the lottery,and the two ends of the lottery are connected to the lottery players and the government,while the middle carries the huge social welfare undertakings such as helping the poor and students,helping the poor and disaster relief,helping the elderly and disabled,and public welfare charity.How to strengthen government Regulation of the sports lottery industry and safeguard the public welfare attributes of sports lottery has become an important topic of widespread concern at home and abroad.As a licensed monopoly industry in China,sports lottery has special attributes,and it is difficult to effectively deal with the above dilemma if the existing regulatory system is fully followed,so it is necessary to continuously improve the level of government regulation of sports lottery industry.Based on the above problems,this paper selects case studies,semi-structured interviews and thematic analysis as the research methods,coding and analyzing the interview data and daily work data,combining the theory of regulatory public interest,the theory of regulatory capture and the theory of responsive regulation,and following the three dimensions of"regulatory system-regulatory agency-regulatory instrument".The governmental regulatory system of Jinan sports lottery industry was analyzed in three dimensions:regulatory systemregulatory agency-regulatory means.On this basis,the three dilemmas of governmental regulation in Jinan sports lottery industry are identified:the legal system of regulation is not yet sound,the organization of regulatory agencies is not smooth enough,and the strategy of regulatory tools needs to be improved.As a result,the causes behind the problems are analyzed,including regulatory bias caused by regulatory capture,poor collaboration of cooperative regulatory mechanisms,and path dependence of regulatory instruments.Based on the analysis of the dilemma and the causes,this paper selects the United States,the United Kingdom and France as the comparative objects,absorbs and draws on foreign advanced regulatory experience,and further reveals the optimization path of governmental regulation of China’s sports lottery industry.First,establish and improve the legal system of government regulation,legislate at the national level,improve the content of legislation,formulate supporting laws,and realize the regulation of sports lottery industry according to law;second,optimize and reconstruct the setting of government regulatory agencies,establish independent regulatory agencies,realize the separation of government and enterprises,and scientifically allocate regulatory power;third,enhance and improve the strategy of government regulatory tools,continuously improve economic regulatory tools,emphasize the use of social regulatory tools,and break through innovative responsive regulatory tools.means,breakthrough innovation responsive regulatory means.By optimizing the path of government regulation,the level of government supervision of China’s sports lottery industry will be improved,thereby achieving healthy,stable and high-quality development of the whole sports lottery industry.
