In the face of the "Russian-Ukrainian war",the economic sanctions imposed by the United States against China,the "Russian Far East Plan" and other new international development needs,the party and the state have made greater efforts to build a strong country in rural revitalization and intellectual property rights.As a major exporter of agricultural products,China’s geographical indication products have important economic,political and cultural multiple values in the international community.Although geographical indications also have the function of distinguishing the origin of goods,geographical indications have a long history and are fundamentally different from trademark rights,which are a legal term created by mankind.Since China’s accession to the WTO,it has continuously learned from the experience of advanced countries,and gradually formed a "three sets of systems,dual-track parallel" protection model in China,which has always had problems such as management confusion and rights conflicts,and has not yet formed a legal protection model for geographical indications according to China’s national conditions.This paper starts from the exploration of geographical icons,distinguishes the essential difference between geographical indications and generic names,and combines the development of geographical indication protection models at home and abroad,refers to the advantages and disadvantages of different protection models in countries outside the region,analyzes the prominent problems of typical cases in judicial adjudication practice for many times,and takes judicial practice as the entry point to explore how to select and improve the protection mode of geographical indications in China.
