Trademark Protection Of Geographical Indications In My Country

The Chinese nation has a long history and a vast territory,which has created a wide variety of geographical indication resources in China.With the continuous development of world economy and trade,the importance of geographical indication is increasing day by day.It is of great practical significance in promoting the overall development of China’s regional economy,ensuring the diversity of commodities and saving social operating costs.Based on the actual situation of China,this paper analyzes and summarizes the common disputes in judicial practice from typical cases,and expounds the discrimination of geographical indication and its related concepts,the nature and function of geographical indication trademarks,and the exis ting multiple protection systems.Then it discusses and studies various problems exposed in the process of geographical indication protection in China,including the serious infringement of geographical indication,the conflict of rights caused by the coexistence of geographical indication right confirmation systems,and the unclear determination rules for the fair use of geographical indication trademarks.Finally,this paper puts forward some effective countermeasures to clarify the identification standard of infringement of geographical indications,integrate the legal norms of protection of geographical indications,and improve the identification rules of fair use of geographical indication trademark rights,so as to accelerate the realization of the grand goal of building "Brand China" in China.
