Research On The Optimization Of People’s Jurors’ Participation Process In T County Court

In April 2018,the law of the People’s Republic of China on People’s Jurors was promulgated and put into effect amid much anticipation.Courts and judicial administrative organs at all levels throughout the country strictly implement the CPC Central Committee decision on reform of the people’s juror system deployment,earnestly implement the provisions of the law of people’s assessors,solid promote the reform of people’s assessors,in regulating the selection mechanism,improving the breadth and representativeness of the sources of people’s assessors,and promoting the substantive participation of people’s assessors in trials,and to win social understanding and support have achieved significant results.Since the implement method of people’s assessors,the Supreme People’s Court,justice and so on related department jointly or separately issued a number of normative documents,to construct four beams eight columns,local people’s courts and judicial administrative organs have formulated corresponding policies to facilitate the detailed implementation of the provisions of the People’s Jurors Law.The courts in China are divided into four levels,and the basic courts account for the largest proportion.Throughout the management the right process of people’s jurors to participate in trial in the basic courts of China,there is a lack of theoretical guidance compared with other links.At the same time,the people’s jurors in the trial played not just supervision,and the restriction effect between the judge,for the study of how to optimize the process of the people’s jurors in the trial,the trial quality of people’s assessors,it also shows that people’s jurors are more and more recognized by the public.Through the reference of relevant theoretical research by domestic and foreign scholars,under the premise of governing the country according to law,first of all,T County court people’s jury participation process as the research object,introduced the T county court personnel structure and the general situation of people’s jury participation;Secondly,combined with the current situation of people’s jurors participation in T County court,and conducted a questionnaire survey in trial process of a questionnaire survey,analyzed the problems and causes of the process of people’s jurors participation in trial adpot results obtained by the survey,and summarized the problems and causes raised.Once again.Put forward a targeted and feasible new optimization scheme of the examination process;Finally,put forward the guarantee measures to ensure the accurate implementation of the people’s jury participation process,to ensure that the stable implementation of the design scheme.
