Research On The System Of Village(Community) Legal Adviser And Its Implementation Path

Since the 18 th National Congress of the Communist Party of China,our country’s theoretical understanding and practical exploration of the socialist rule of law have reached a new historical height.Governing the country according to law in an all-round way is the essential requirement and important guarantee for upholding and developing Socialism with Chinese characteristics.It is related to the development of the party and the state,governing and rejuvenating the country,and people’s happiness and well-being.In order to comprehensively promote the rule of law,the state pays great attention to the construction of the legal system in the grass-roots villages and communities.To this end,the state has established a system of "one village(community)and one legal advisor",trying to establish a sound legal system for communities and villages,and better provide legal services to residents.However,according to the actual situation,the process of promoting the "one village(community),one legal adviser" system varies across the country,and there are many problems in the key aspects of implementation that need to be further resolved.In-depth insight into the current status of the construction of the community legal adviser system,to clarify the key issues in the construction of the community legal adviser system,and to propose targeted optimization strategies are of great significance for improving the construction of the community legal adviser system.This study selects Jilin Province as an actual case,based on the current situation of the construction of the community legal adviser system in Jilin Province,through the analysis method of social investigation,summarizes the current situation of the construction of the community legal adviser system in Jilin Province from the two aspects of policy development and the construction process of the community legal adviser system,the study found that Jilin Province has made a good exploration in the construction of community legal counsel system,and has a clear plan for the future.However,in the process of system construction and implementation,there are still many problems that need to be further resolved.This study makes an in-depth analysis of the key issues faced by the construction of the community legal counsel system from the government level,the social level and the market level.,social participation and many other issues.The research is finally based on the basis of the new public service theory and the public policy process theory,and with reference to the benchmarking experience,it puts forward three stages of thinking on the construction of the community legal counsel system at this stage,and elaborates on the primary stage,the intermediate stage and the advanced stage respectively.Strategies are suggested in order to provide reference for Jilin Province to promote the construction of community legal counsel system.
