| The pace of today’s society is accelerating,social innovation and development are coming at an unprecedented speed,and the level of industrial production and technology continues to improve.We are in the era of network information,and the Internet is gradually changing people’s lifestyles and behavior patterns.With the rapid development of mobile networks,the Internet has become an indispensable part of our lives.The popularity of the Internet has also increased the way the market competes.It is a well-known secret that many of these businesses conduct unfair competition through the Internet in order to increase sales in order to pursue profits,especially online false propaganda,such as fraudulent purchases,wrong goods and so on.Affected by the epidemic in 2020,it can be seen that the network economy has entered a stage of rapid growth.With the rise of various e-commerce platforms and online live broadcasts,online false propaganda incidents continue to occur,which seriously affects the network environment and market competition environment.It can be seen that my country’s supervision of online false propaganda is imminent.At present,in terms of network supervision in my country,although the "Anti-Unfair Competition Law"revised in 2017 has revised the false propaganda laws and added legal regulations on the use of the Internet to conduct false propaganda,in the "Advertising Law"," It is also reflected in departmental laws such as the Consumer Rights Protection Law,but in specific cases,the practicality is still lacking.Compared with traditional false propaganda,online false propaganda is more difficult to supervise due to the concealment,high technology and fast dissemination of the Internet.For online cases,supervision should be strengthened.Only with a good online competition environment can the online economy develop rapidly and the online market can move forward in a stable and orderly manner.By discussing the various theories and differences existing in the current stage of online false propaganda,this paper attempts to use the author’s own understanding and learn from each other’s strengths,synthesizing the advantages and strong arguments of various theories,and put forward my own opinions on the nature of online false propaganda.Think,try to give the author’s argument for the behavior in question.With reference to the mature experience of the common law system,the civil law system and other countries and the advanced legislative models of other countries,it gives its own legal definition for the false propaganda that has not yet been determined.At the same time,it conducts in-depth research and discussion on the emerging industry of live video delivery,and develops a legal path with Chinese characteristics to regulate online false propaganda.Among them,the author mainly uses three research methods:literature research method,case analysis method,and comparative analysis method research method,focusing on the analysis and interpretation of online false propaganda behavior.By analyzing and comparing online false propaganda behaviors,comparing the applicable laws and regulations that have been formulated in my country at this stage,integrating advanced and mature foreign experience and corresponding legal systems and applying them,put forward corresponding suggestions and countermeasures.Hope that the online market will be healthy and prosperous developing. |
