The Study On Value Structure Of The Organic Law Of The Urban Residents Committees Of The PRC

As a mass self-governing organization of urban grass-roots communities in China,the residents’ committee is of great significance to the implementation of grass-roots self-governing system in China.As an important legal basis for the establishment and operation of the residents committee,The Organic Law of the Urban Residents Committees of the PRC is the concentrated embodiment of the will and interests of the state and the people,and contains abundant value elements.In-depth study of its value structure is conducive to a deeper understanding of the value orientation of legislators and the correct value guidance to the public.The formation of it is a process of optimizing the value of law,value judgment and value orientation.It is a constitutional law,which is a value whole built up by a certain structure.From " The Work Instruction On Abolishing Baojia System And Establishing Residents’ committees" to "The Organic Law of the Urban Residents Committees of the PRC",the value elements of the the system of community level self-governance have been enriched and optimized with the development of the times.It has constructed a multi-value system including order,democracy,efficiency,justice,equality,civilization,rule of law and other value elements.From the research status of value structure and community autonomy system,it can be seen that there are few studies on the "The Organic Law of the Urban Residents Committees " from the perspective of value structure,and there are systemic problems in all the studies.This paper tries to study the distribution and structure of order,democracy,efficiency and other value elements in "The Organic Law of the Urban Residents Committees ",and explore the commonness between their own values and constitutional values,as well as the pluralism and uniqueness of their own values.On this basis,according to the requirements of The Communist Party of China and the state on grassroots governance,combined with the new situation and new problems in the construction of urban grassroots communities in recent years,the author puts forward specific ideas on optimizing the value structure of the "The Organic Law of the Urban Residents Committees ",promotes it to form a scientific and reasonable structure system reflecting the recognition of realistic values,This makes each value have a reasonable social function,which is conducive to reaching a consensus among all social strata,forming a joint force,and then promote the continuous improvement and development of the legal system of urban grass-roots community autonomy.
