Research On The Value Structure Of Local Organizational Law In China

China’s local organization law refers to the organic law of the People’s Republic of China on local people’s congresses and local people’s governments at all levels.It is the basic law to guide the work of local people’s congresses and governments,including the emergence,functions and powers of local people’s congresses and governments.The value structure of local organization law refers to the positive effects that the law itself should have,and these positive effects change dynamically,thus forming the structure between value elements.The research on the problems related to value structure occupies an important position in the legislation and implementation of local organizational law in China.It is also a basic problem that cannot be bypassed and must be faced in the field of local organizational law.As an important part of China’s legal system,local organizational law has an important value structure.To sum up,the basic values of socialism with Chinese characteristics,the main values of central unified leadership,people’s democracy and local autonomy,the target values of safeguarding justice,protecting human rights,improving efficiency,promoting equality,stabilizing order and promoting democracy,as well as the real values of promoting political,economic and cultural development.On the basis of reviewing the background,formulation,modification,perfection and positioning of local organizational law and comparing with similar foreign local organizational law,this paper analyzes and discusses the value structure of local organizational law,the relationship between values and the dynamic change process of value,in order to explain the value structure of local organizational law in China and further strengthen the attention to the value structure of local organizational law.At the same time,the article also points out the theoretical and practical problems that can be solved by the value structure of local organizational law,and puts forward some suggestions to optimize and improve the value structure of local organizational law,so as to better promote the improvement and Realization of local organizational law,and make a modest contribution to comprehensively promoting the construction of the rule of law in our country on the new journey.
