Research On The Legal System Of Administrative Supervision Of Railway Construction Project Bidding

By January 2022,China’s total railway mileage has reached 146300 kilometers,of which the operating mileage of high-speed railway has exceeded 40000 kilometers.The investment of railway construction projects is huge.Carrying out bidding activities in accordance with laws and regulations is the basic requirement for the normal operation of market economy.At present,the bidding law of the People’s Republic of China is facing major revision.Under the background of the continuous deepening of the reform of "release management and service" and the rapid popularization of electronic bidding,it is necessary to carry out the research on the administrative supervision system of railway construction project bidding.Firstly,it analyzes the current situation of administrative supervision of railway construction project bidding.This thesis analyzes the main body,authority,obligation,procedure and responsibility of the administrative supervision of railway construction project bidding.Sort out the ways in which the State Railway Administration and regional regulatory bureaus implement the administrative supervision of bidding by means of filing,supervision and inspection.Secondly,using the methods of literature analysis and investigation,this thesis combs out the five prominent problems faced by the administrative supervision of railway construction project bidding,including the weak strength of railway administrative supervision,the unclear division of local railway supervision power,the supervision mode of railway supervision department needs to be improved,the business environment in the field of bidding needs to be further optimized,and the lack of operability of dishonesty punishment and trustworthy incentive system in the railway industry.Finally,it puts forward some suggestions to improve the administrative supervision system of railway construction project bidding,including the following aspects: first,we can try to buy social services.Second,build a collaborative supervision model dominated by local railway controlling parties and supported by railway industry departments,and explore a new mechanism of local railway collaborative supervision;Third,improve the supervision means of electronic bidding;Fourth,refine supplementary materials,supervision standard bidding documents and other work,and continuously optimize the business environment of railway construction project bidding market;Fifth,increase the scope and intensity of punishment for dishonesty,improve the operability of trustworthy incentive measures,and improve the credit supervision mode of railway construction project bidding.The research results of this thesis can provide some reference for the railway industry supervision department to improve the bidding administrative supervision,and provide some suggestions for improving the bidding administrative supervision level of the railway industry supervision department.
