The public right to environmental education is a right with intersectional attributes under the trend of ecological civilization education and environmental human rights protection.It is also the key content of promoting ecological civilization construction in China.However,there are some defects and shortcomings in the current research situation of public environmental education right in China.Therefore,to explore what the right to public environmental education is,what to do and how to use it is the way to regulate it.First of all,the article begins with the distinction and connection between the right to education in the public environment,the right of public environment and the educational right.On the basis of expounding the public right to environment and the right to education,the author defines the meaning and characteristics of the right of public environment education as a whole,and elaborates the value and historical evolution of the public environment right of education.Secondly,the article further analyzes and discusses the components and specific powers of the right to education in the public environment.The analysis and understanding of subject,object and content is the most basic part of the right to receive education in public environment,and the power and power elements are the core part of its attribute.Finally,focusing on the environmental education legislation and the development of environmental education in China,this paper analyzes the current situation of the public right to environmental education,from which it analyzes many problems existing in the legal protection of public environmental right to education.Specifically,there are three core issues:imperfect legislative protection of the right to education in the public environment,administrative inaction and improper actions,and unsmooth relief channels.Therefore,this needs us to carry on the pointed consummation according to the realistic predicament.It is the legislative guarantee,the administrative guarantee and the judicial relief aspect three aspects to be consummated,in order to realize to the public environment education right practical legal safeguard.
