Research On Legislative Issues Of Data Security For Government Services

With the continuous development of computer technology,the construction of e-government has been expedited globally and gradually become the focus of modern government innovation.The development of e-government has given birth to government data,a new strategic resource,which includes all aspects of a country’s economy and society.Nowadays e-government has a very important strategic value,which leads to a series of nontraditional security issues frequently,such as data leakage,hacker attacks and irregular data collection by state organs.In order to prevent and defuse the security risk of government data,it is necessary to regulate it by law.China has already adopted the “Data Security Law”to design the system of government data security,and local legislation also makes special provisions for government data security,forming a relatively complete legal system design for government data security.However,there are still some shortcomings in the existing legislation on government data security in China in terms of legislative hierarchy,connection between central and local legislation,and construction of important systems.This paper takes the existing legislation on government data security as an entry point,and through the analysis of the existing legislation on government data security,discusses the existing problems and proposes relevant solutions,and makes corresponding suggestions for the improvement of the legislation on government data security.Based on the existing legislation on government data security in China,this article analyzes the current situation and discusses issues around specific provisions,and makes corresponding suggestions for the improvement of government data security legislation.The article is divided into the following parts: Chapter 1 is the introduction,which mainly introduces the research background and significance of this paper,excavates the current status of domestic and foreign legislation and doctrine,and introduces the research method,innovations and deficiencies of the article;Chapter 2 is the overview of government data security legislation.This chapter firstly defines and distinguishes the concept of government data and similar concepts,and then clarifies the subject of the article,the concepts of government data security and government data security legislation,which determines the research center of the article;The third chapter mainly analyzes the current administrative data security legislation and explores the enlightenment brought by the evolution of China’s data security legislation to the government data security legislation.Meanwhile the paper also analyzes the legislative concept,power subject,system design and system design of China’s government data security legislation,and analyzes main problems existing in legislation,mainly including imperfect legislation,enormous differences in local legislative structures,insufficiency on legislative refinement and implementation,and imperfect construction of important systems;Chapter 4 discusses the problems of the existing legislation,suggesting to speed up the introduction of administrative regulations and rules on government data security and local regulations,so that the central government and local government can be effectively connected;to clarify the responsible subjects of government data security,improve the operability of government data security system,and regulate the rights and obligations of third parties;to speed up the improvement of the classification standards and types of government data security,formulate a complete identification system of important government data,and clarify the ownership of government data;to adhere to the consciousnesses of local legislation,and to improve the construction of local government data security legislation system with the Data Security Law as the outline.
