| Markets of agricultural products are closely related to people’s lives.Realizing the normal and long-term management of markets of agricultural products is one of the important matters of local administrative supervision and the construction of urban governance system.How to use the law to build rules,improve the rule of law,provide legal guarantee for the management of the markets of agricultural products,and make the relevant legal provisions in line with the local actual situation is the demand of today’s markets of agricultural products legislation.Judging from the legislative activities of some provinces and cities across the country in recent years,Yangzhou,Ningbo,Chenzhou and other places have formulated local regulations on markets of agricultural products.The legislation of markets of agricultural products has received the attention of local legislatures and has become one of the legislative items of some local legislatures.Therefore,local legislative research on markets of agricultural products is necessary.Markets of agricultural products are typical market-type trading market,which have the characteristics of quasi-public goods and externalities,and there are conflicts of interest.Markets of agricultural products are important livelihood projects.The regulations of the markets of agricultural products can provide a strong guarantee for the legal management of the markets of agricultural products.Therefore,the local legislation of the markets of agricultural products is necessary.According to newly revised The Legislation Law of People’s Republic of China in 2015,local legislatures have legislative powers for the management of markets of agricultural products,and the state has promulgated relevant policies and legal documents,so local legislation for markets of agricultural products is feasible.The empirical investigation of Nanchang,which has typical significance,found that the relationship between stakeholders involved is complex,and there are problems in management policies,planning and construction,operating norms,supervision and management,and related legal responsibilities.From the perspective of legislation,the reasons for the problems are analyzed.From the old regulations,it can be seen that there are mainly defects in legislative purposes,legislative principles,legislative methods and specific content.Through the empirical analysis of the actual problems and legislative problems of markets of agricultural products in Nanchang,it is found that there is a close connection between the legislation of the markets of agricultural and the management of the markets of agricultural.Inspect the legislation of markets of agricultural products at home and abroad.Foreign markets of agricultural products legislation adheres to the guidance of the government to ensure the public welfare of markets of agricultural products;Domestic markets of agricultural products legislation is mainly improved in terms of increasing financial support,rational distribution of administrative responsibilities,scientific planning,improving legal responsibilities and so on.To sum up,the local legislative work of markets of agricultural products should be carried out in four aspects.The first is to formulate legislative objectives,mainly from three aspects: standardizing operation and management,promoting the development of markets of agricultural products,and protecting rights and interests.The second is to clarify the legislative principles,mainly including the principle of local characteristics,the principle of non-contradiction,the principle of operability,the principle of balance,and the principle of multi-subject participation.The third is to establish a legislative system,and the most reasonable way is to adopt regulations.Fourth,improve the specific content of laws and regulations,and revise management policies,planning and construction,operating norms,supervision and management,and legal responsibilities. |
