At present,China is introducing a policy to promote fertility represented by the "three-child policy".However,under the background of this policy,China’s current female labour rights and interests protection system is indeed facing many difficulties,which is mainly reflected in the gender discrimination of female workers in employment and the insufficient protection of the rights and interests of female workers in the "four phases".The maternity rights and interests of female workers are not guaranteed enough.The existence of these problems will in turn affect the smooth implementation of the "three-child policy".The main reasons for the current dilemma of safeguarding women’s labour rights and interests in China are: traditional gender culture deeply affects employers,there are provisions in the current law protecting women’s labour rights and interests that are not conducive to achieving equality between men and women,China lacks special laws to protect women’s labour rights and interests in the field of anti-employment discrimination,and there is a conflict between women’s labour rights and employment autonomy,and the employer’s illegal cost is low.In order to solve the current dilemma faced by the protection of women’s labour rights and interests in China and better promote the realisation of the three-child policy,through analysis and combined with China’s specific national conditions,this article believes that it is mainly necessary to solve the current problems in the protection of women’s labour rights and interests in China from four aspects.The first is to improve the legal guarantee system for women’s labour,such as formulating a gender impact assessment system and accelerating the promulgation of the Anti-Sex Discrimination Law.Secondly,strengthen the implementation of the current legal system for protecting women’s labour rights and interests,such as strengthening the implementation of the legal system of labour supervision,strengthening the implementation of the system for the protection of women’s reproductive rights and interests,and strengthening the civil and administrative punishment of illegal employers.Thirdly,it is to improve the social security construction of women’s labour rights and interests,through the introduction of supporting measures to protect the economic rights and interests of employers and attach importance to the cultivation of employers’ awareness of social responsibility.Finally,explore the establishment of a "substitution system for pregnant female workers". |
