As a representative artificial intelligence technology,the development of self-driving technology has been highly valued by many experts and scholars both at home and abroad,and is also full of hopes and concerns.Among other things,the birth and use of self-driving cars is one of the most far-reaching and significant changes in the recent history of transport development;and there are significant differences in the way self-driving cars are driven compared to conventional driving methods,so that the driver of a self-driving car can no longer be considered a real driver,and this change poses a challenge to the traditional assumption of responsibility for motor vehicle drivers,in front of criminal law,such as questions such as "the criminal liability of self-driving cars in car accidents" and "who should be held criminally responsible for a particular offence" need to be carefully thought through.Because of the new challenges posed by autonomous driving technology in the context of intelligence,it is important to clarify the causal link between the two by refining the responsibilities and obligations of each party and to address these issues through sound corresponding criminal law norms.This is an inevitable requirement for promoting the development of the autonomous driving industry and accelerating the implementation of autonomous driving technology,but also raises new issues for the reasonable regulation of traffic accidents and other acts in the criminal field,which requires our in-depth study.The first part of the paper focuses on an overview of self-driving cars,briefly explaining the concept of autonomous driving,the classification standards for self-driving vehicles,as well as the development of the industry and the current state of legal regulation of self-driving cars.The second part draws out the three main points of contention regarding the subject of criminal liability,duty of care and related offences through specific cases,and analyses the necessity of criminal liability.The third part elaborates on the controversial issues of criminal law involved in traffic accidents involving self-driving cars and provides an insightful theoretical analysis of the criminal law dilemma in which they are located.The fourth part proposes tentative suggestions to improve the criminal law in terms of criminal subjects,the identification of crimes and their revision,and explores feasible criminal law response suggestions in self-driving car traffic accidents. |
