| Behind the prosperity of Gig Economy and the growth of platform lies the problem that the labor rights and interests of Gig Economy practitioners cannot be effectively guaranteed.As the group of Gig Economy practitioners gradually grows,the social problems caused by them increase,and the voice for protecting the labor rights and interests of Gig Economy practitioners is getting louder and louder.However,the vagueness of the standards for identifying labor relations,the limitations of the dichotomy of labor relations,and the discipline of algorithms make this problem complicated and cannot be solved by taking measures from one aspect.Therefore,in order to protect the labor rights and interests of Gig Economy practitioners,a set of hierarchical institutional systems can be constructed in the following ways.Firstly,reshape the standards of labor relationship identification.This can be based on the existing subordination standard itself,or it can learn from the ABC test standard in California,and adopt a falsification method to determine the labor relationship.Secondly,build a third-type labor system and grant corresponding rights to protect the labor rights and interests of Gig Economy practitioners who cannot be identified as having a labor relationship with the platform according to the new labor relationship identification standards.Finally,On the one hand,Gig Economy practitioners are given collective labor rights,enabling them to form industrial trade unions and protect their own rights and interests through collective negotiation;on the other hand,strengthen the supervision of platform algorithms to protect the labor rights and interests of all Gig Economy practitioners. |
