| Cross border human trafficking is a serious international crime second only to the crime of smuggling weapons and drug trade.The United Nations global plan of action against human trafficking(2010)clearly stipulates that human trafficking is a criminal activity against human dignity,which has a serious negative impact on development,peace,security and human rights.China is also one of the parties to the international treaty,and has actively formulated specific implementation measures according to the contents of the treaty,with remarkable results.Based on the long border and complex geographical location,the crime of cross-border human trafficking has been gaining momentum and has become a "cancer" that endangers the border areas.In the face of the rampant trend of cross-border human trafficking crime,in addition to cracking down on crime and preventing crime,the human rights protection and relief of "victims" in the process of human trafficking crime should also attract more attention.In some remote rural areas where the economy is backward and the development of the civilized society is not high,the phenomenon of people buying and selling has always existed.Buying foreign "brides" has become the first choice for many older men to solve their marriage problems.Aiming at the problem of remedies for the protection of the rights of victims of abduction to China,this thesis takes "referral" as the starting point to discuss the insufficiency of domestic referral work.Referral of victims of human trafficking refers to a cooperative mechanism in which government departments and social organizations jointly protect and promote victims’ rights and relief in the process of combating human trafficking crimes.Through case integration and theoretical analysis,the paper examines the actual living conditions and practical problems of victims of "trafficking to China",and analyzes and demonstrates many problems existing in the referral work of victims of human trafficking in my country.First of all,the identification of victims of "abduction to China" is insufficient.At present,there is no set of written and systematic screening procedures and standards in China for the reference of case-handling personnel.With their own experience and discretion,there is great uncertainty.It is imperative to improve and perfect the victim identification procedures and establish identification standards.Secondly,my country’s foreign-related marriage legislation is not perfect.It is difficult,unrealistic,and costly for victims of abduction to register their marriages in accordance with China’s current laws and regulations.This directly leads most families to abandon the step of marriage registration.,is not conducive to the stability of social order.In order to encourage foreign-related marriages and families to take the initiative to go through the marriage registration procedures,the registration procedures should be optimized from the source to reduce the difficulty.Finally,most of the victims of abduction to China are unable to apply for permanent residence status in China according to the current policy.All in all,no matter from the perspective of the government or the society,all kinds of problems encountered by abducted women in China should be solved with an accepting and inclusive attitude,rather than ignoring them.Internationally,some developed countries or regions have actively explored the work of referral of victims of human trafficking and achieved remarkable results,which has important reference value for my country to establish and improve the victim referral mechanism. |
