Human trafficking is a serious crime and a grave violation of human rights. Severe measures have been taken to combat human trafficking both domestically and abroad. China has launched many specific human-traffic fighting activities back in the year of 1990,2000,2002 and 2007. However, although the geographic coverage of these crime fighting activities increased over the years, such crimes still happen repeatedly. It is mainly because abducting women and children in our country has a rather complex route. In recent years, human trafficking for the purpose of labor and sexual exploit has emerged, the crime also shows a trend to be internationalized. This article analyzes the current condition of human trafficking from aspects of legislation, economic policies, social policies as well as social management policies, then presents improvements on combating human trafficking.The first part of this article analyzes the reasons behind China’s human trafficking crimes. The analysis focus on the three stages of the crime:the Beginning, the Deterioration and the Internationalization.The second part of this article presents a comparison of the laws that punishes against human trafficking, including comparisons between different historical periods in China, between sovereign countries other than China, and between laws of sovereign countries and international treaty. Through the comparison we shall find that the conflicts among laws of sovereign countries and international treaties are very hard to reconcile, therefore the international treaties should be domestically legislated.The third part of this article focuses on how to reconcile domestic law and international treaty as well as how to combat human trafficking and maintain social stability. We should first study how to reconcile domestic law and international treaties on system level. Then analyze how to combat human trafficking and maintain social stability on implementation and concept level. Finally, based on the reasons behind such crimes and related laws and regulations, we propose feasible recommendations about China’s legislation on human trafficking.
