| General Secretary Xi Jinping stressed at the 2020 high-level meeting of the United Nations General Assembly to commemorate the 25 th anniversary of the World Conference on Women in Beijing that the protection of women’s rights and interests must rise to the will of the state.For the protection of women’s rights and interests,especially rural women’s rights and interests in recent years has become a widely discussed topic in society,the topic of this article belongs to the scope of rural women’s rights and interests protection,mainly focusing on the middle and late stages of urbanization,frequent land requisition and demolition activities on the one hand to increase the income of rural residents,on the one hand,the rights and interests of a large number of "foreign-married women" in rural areas have been repeatedly infringed.Due to the influence of various factors,foreign-married women often do not enjoy the dividends brought by urbanization well,but have become vulnerable groups due to the serious damage to the land rights and interests they should enjoy.This study first introduces the formal system and village rules and regulations,the land rights and interests of foreign married women and foreign married women,taking the conflict between the formal system and the informal system as the fundamental perspective,and analyzing the 120 judicial adjudication documents on land rights and interests disputes between foreign married women in Guangxi with the help of the analysis framework of "raising problems-analyzing problems & presenting conflicts-coping strategies",and the focus of the problem is that the formal system stipulates that foreign-married women enjoy the same land rights and interests as other villagers,but in the process of distribution in village collective organizations,However,it is often excluded from the distribution list of foreign-married women,or the proportion and number of foreign-married women are restricted.Next,through the combing of the demands,the corresponding conflicts are further presented,and from the perspective of government governance and rural governance,the responsibilities,motivations and interests of all parties to the conflict are comprehensively analyzed to reveal the causes of the conflict: in the face of the possible abuse of autonomy by village collective organizations,it is difficult for the government to realize the right to supervise,and the contradiction between the land rights and interests of foreign-married women cannot be "resolved on the spot" Some foreign-married women choose to sue the court to protect their rights,but the court sometimes falls into a dilemma in the face of conflicts between village rules and civil agreements and formal systems.Finally,on the basis of grasping the focus of the problem,deeply understanding and analyzing the causes of conflict,and according to the characteristics of the conflict and the requirements of the times for social governance,rural revitalization,and common prosperity,the "people-centered" governance concept and the collaborative governance theory are integrated to obtain the coping strategy for the problems proposed in this study,that is,the introduction of diversified governance subjects,the adoption of diversified dispute resolution methods,the strengthening of the regulation and supervision of village rules and regulations,and the improvement of the social security system to promote the modernization of rural governance. |
