In recent years,the rapid development of Internet platforms,the continuous expansion of scale,and the continuous growth of influence have brought profound changes to the operation of the economy and society.The platform economy based on the Internet and information technology is the third stage of the Internet platform after it spans the e-commerce platform and the industry platform.Due to the unique network externality and technical concealment of the platform economy,coupled with the widespread use of big data,one of which is the increasingly prominent phenomenon of “Big Data Bias”.“Big Data Bias” is a typical embodiment of the market that plays a decisive role in resource allocation in the era of “Big Data Bias ” and the government’s macro-control and market regulation,which has not been effectively coordinated,exposing new problems in the new market situation such as data resource competition,market monopoly,price discrimination,data leakage,and algorithm abuse.In order to deeply analyze and solve the legal problems related to “Big Data Bias”,this thesis uses a variety of methods such as questionnaire survey method,normative analysis of a questionnaire of “Big Data Bias” from four aspects: phenomenon,path and cause,nature,and internal and external legal systems.Among them,the phenomenon analysis mainly understands the manifestation of “Big Data Bias” and the degree of public awareness through investigation;the path and cause analysis clarifies that “Big Data Bias” is based on differential pricing,and the monopoly in the field of platform economy is increasingly serious as the basic condition,of course,the most direct factor lies in multiple information asymmetry;nature analysis mainly focuses on the rationality,legality and legal nature of“Big Data Bias”;regulatory analysis focuses on identifying the regulatory limitations of current domestic legislation,and draws on foreign experience.Then make targeted recommendations.The main results of the study reflected in this thesis are embodied in: 1.Clarify the meaning of “Big Data Bias” and reveal its legal nature;2.Systematically sort out the regulatory limitations of China’s current legislation;3.It is recommended to implement the linkage regulation of relevant laws,strengthen the protection of consumer rights and interests,and refine the provisions on personal information protection,with a view to achieving effective regulation within the existing legal framework.
